Changing jobs after 180 days of I-1485 pending/ I-140 approved.
Simple question:
1. Should I file AC-21 Memo with USCIS or not?
2. What are the risks of filing AC-21?
Note: I am working on EAD in Texas and my Labor was at IL but similar job.
3. Does Ac-21 always trigger a RFE and/or Interview?
4. What are the advantages of filing AC-21?
Please advise.

I understand you don’t care about the United States and its people and you’re only interested in what you can gain from them but if you weren’t so blinded by greed you’d see this is something else they can give to you. Now I know why I took the route I did, I would have accomplished far less in my personal life with the likes of you. In fact, I may doing to much sharing my expertise with you. I refuse to have my name tarnished any further. Besides, you’re only a beginner. What was I thinking? IV really ought to make it clear to everyone that this is an amateur site. Maybe by changing its name to Beginning Immigration. IV definitely is not the voice of Immigration – my voice is different from IVs and I’m dealing with immigration. Thanks for sharing your expertise. But unfortunately we are not in the drug trafficking business. IV is only for legal employment based immigrants. This is clearly stated in the IV policy.

Since the H-1 will be cancelled by the previous employer, the answer is No.
I am more curious to know if you can use the EAD in conjunction with the H1B (working 2 jobs 1 on H1B and one on EAD).

That post was intended towards EB3 category, particularly EB3-India. Ever since starting of this Fiscal Year there are very few EB3-India approvals (Can anybody dispute that?). So how come USCIS used up all the visas already?? Most of the guys here always talk about EB2-India which is not highly effected category in the first place. We suppose to be taking care of effected categories.

We filed our AOS, EAD and AP on Aug 13th at NSC. We are from Santa Clara county in california. I heard that people from santa clara are getting FP's very late?
We have got our Receipts on Sept 30 and EAD on Oct 28th. No FP and AP yet.
My question is how to create service request?
We are planning out of country. Just waiting for this FP to be done.
Can we postpone FP for a specific period of time?

EMPLOYMENT: Demand for numbers in the Employment Third �Other Workers� category, as well as the China and India Employment Second preference categories, has been escalating. No movement in those cut-off dates will be possible until the current level of demand subsides.
Translated that means, the Tsunami of 245i and Backlog labours is hitting, there can be no movement until this improves.
In other words, absent legislative action to allow more visas, you are lucky if dates do not retrogress.
We should stop following bulletins and focus more on lobbying.

Was this is a change in the procedures of USCIS? If yes, could we not request them to increase the length of the EAD from 1 to 5 years? This will help many of us too. I need to get my DL renewed every year along with the EAD.

Hi, I got the email today that my AP has approved and they have mailed the document.
Few things i did to expedite so that I don't have to cancel my tickets and thanksgiving plans.
5 Days before the end of 90 days. I called NSC and requested to expedite the process in financial loss category. They told me that I'll get some information with in 5 days. I got letter in mail that they are working on it. Regular receipt letter nothing much information
2) Exactly after 90 days of filing my application (Nov 4th) I took an infopass appointment to talk to the officer. She told me that we cannot expedite as this is not a medical emergency or any other kind of emergency. I told her that i have already got my tickets and i made the plans after normal processing times of 90 days. She said she cannot do anything except sending an email to USCIS about my case. She also said if you have any family medical emergency we can issue a AP here but as I don't have one we cannot do anything.
3) Same day I sent a cover letter with DHS Form 7001 to CIS Ombudsman explaining my situation including copy of financial loss documents (tickets and all.)
After around 9 days I got a email today that its approved. I had lost hope and was planning to cancel my tickets coming Monday.
I am not sure whats the reason it got approved. May be its just over 90 days and it was supposed to get approved or its because of CIS Ombudsman.
I am glad that now I can travel as planned next week and don't have to cancel my tickets provided I'll get the document in hand early next week.

Fraud is usually about lie. If you hide a material fact from USCIS, that is a lie by ommision; and becomes a fraud if it was done intentionally. Changing employment while on EB GC application is a material fact and would matter much when USCIS decides on your case.
Usually, this kind of ommision is found out when the individual applies for another immigration benefit or for Naturalization.

you think it is safer to submit the last 2/3 paystubs while on H1 earlier along with the other documents we submit while filing for H1, or not even submit them.. I know the officer is at full liberty to ask whatever document he fancies at that moment and my stars at that time..
Do you think they will ask for the W2's while on H1 period..?

Yes Concurrent filing available,,, but no premium processing for I140.
