    Do you expect this forum to be pro-employer when most of them are for lack of better words were screwed by consultants? People and relationship are important. Also, what is put on paper matters. As a matter of goodwill why cant the employer strike off that clause? Nobody is serving here. Businesses make money, investing in people, products and services. Why would an employee be subject to such clause like withholding the compensation, if employer for valid reasons wants to separate from this company? Immigrants are cautious because of the environment. This has nothing to do with Indians or desis or any race.

    When you sign a contract, it is always better to read it, validate with others, seek legal advice(if needed/available) and sign. Because contract has legal binding unless it violates any law.

    Again, this could be a boiler plate clause, but not a clean clause like,

    "If one doesn't want to choose medical coverage, company will pay 5K extra as bonus very year" ;)



    Well, I read all the posts on this thread, they seem too cautious and pro employee. My advice to you is
    1) People and relationships are more important than money. This is true only if the people are of high moral standard. If your company is going to teach you things (it is generally the case) then be receptive and serve them well. They might give you a raise. If they are prepared to invest in you, you should be prepared to invest in them. This will improve the image of indian workers.

    2) The clause you are stating is not very bad. If you own a company and you teach your workers skills, you want something in return. You can avoid complications by making sure to clearly document what you already knew and what has been taught to you.

    3) There are things called trade secrets. If the company teaches you these secrets you should not disclose it to others. Otherwise your ass is grass.

    4) This is not the same as the 200,000$ bonded contract settlement precedent cited in the thread. It may not apply to your case. This is also not a legal forum. Pay 200$ consulting fees and talk to a lawyer and get advice. Don't loose sleep! and post that response here!!!!

    We as immigrants tend to be too cautious. This is good, but it should not be in the way of good relationship with employers. Prepare for the worst and hope for the best!!!

    This guy with absolutely clean record was held for 11 weeks for verification and lost his father in this process..

    I have been trying for last 8 weeks non-stop in front of computer and I am not able to even see any open appointment...

    WE REALLY NEED TO RAISE HELL ON THIS...


    SENDING LETTERS TO CLINTON or may be IV rep team to meet her on this issue...

    A lot of guys are stuck and have suffered for no reason...

    Can you bring your friend here. If we can add stories from people who suffered, it would add more value.

    (d) Form I-140 Petition Must be Approved Prior to a Favorable Determination of a �106(c) AC21 portability request.

    this could be read 2 ways...either you need have an approved I-140 prior to filing for portability OR the adjudicator needs to approve the I-140 prior to determining portability.



    According to the 2005 memorandum, it was possible to change employers even if the 140 was not approved. But it was clear that an RFE that was not responded to, would deny everything.

    Now it appears, they would require an approved 140.

    BTW, can you call and ask if you case is preadjudicated. In our case my #@$@ lawyer refuses call USCIS or allow us to initiate an SR (one of the reasons why we had no idea that we were stuck in namecheck)

    ALIA post doesnt help India and China EB3's (i am EB3 too). Assuming that 50% of the people who pre adjudicated are from India with a 50-50 split between eb 2 &3. We cannot expect any movement because we have ~25k EB3's ready for approval with only 3-4k visas. Eb2's (I)could be in a slightly better situation by July '10 because of spillover from unused EB1's and EB2's. I am guessing that 12-15k EB 2's will benefit. The only sliver lining is that ROW's who had visa's available but were stuck due to processing delays will be relieved from the pain.


    Hi 485Me and h1Tech,

    I was trying to follow up on my RFE document submission. So, I called them up and said that the online status indicated that a decision would be made within 60 days and I am yet to receive any decision. THen she said that it's a standard message and that my case is pre-adjudicated ( meaning they have all the docs necessary to make a decision on my case ) and I should just wait for a Visa number. Hope this helps.

    Once the dollar touches that low, expect huge salary cuts across the board for the employess of these companies.

    Yeah, easy money overnight is not always possible. Business in general is never easy. Lot of people think it is. People used to easy money, can never adapt to tough times. Those capable hard working businessmen who can adapt to any situations are the real businessmen.

    i think CP filers have a valid point to argue for relief. clearly there is an injury to CP filers as the dates were moved forward creating the impression that they will continue to do so or at least hold steady. legal opinion was also in favor of CP based on individual circumstances in many cases. many of these filers already underwent a lengthy BEC process, which newer Perm/I-485 filers never went through. the government flip flop is the cause of this additional injury.

    instead of asking for specific fixes to be put in, CP filers should articulate this problem clearly and get legal opinion as to possible relief measures.

    great point mr internet then I think CP filiers should other way to make their efforts and should not participate in letter campaign since there are lot of people who are waiting in CP queue.....anyway are you British...it seems to me from your reply:rolleyes:

    actually Gotcher has a very valid point. USCIS creates rules based on their need and 'flavor of the month'. They should be open with their practices. We can then calculate the time it will take to get out of this mess.

    Once FBI name checks were a great deal, now they are ok to issue GCs in the interm, thousands were screwed in the process. Some times it is FIFO sometimes it is received date, sometimes it is something else. There are thousands whose professional lives are hanging at the mercy of these rules and arcane methods of functioning.

    that's what happened with us as well.. Waiting for 80 days now on AP and already changed the tickets twice..



    ramus, i dont think local office will issue AP unless its an emergency. I am saying this bcoz i was in the local office today and they made it clear unless its absolute emergency AP will be issued only by NSC. In case of emergecy you need to show a valid proof that someone in your family is seriously sick.

    What is the procedure to file Tax from India?

    1. Designate one of the tax filing companies (HR block etc ...) as your agent by filling a form (check IRS web site) and give it to your. Your company will issue W-2 to this agent. You have to pay filing fee in advance to the tax filing company.

    2. If your company issues W-2 electronically and your banks/financial institutions produce 1099s electronically, you can file the returns from India electronically and direct refund to your bank account.

    Amongst Google video or Y-Tube was a report that TVU in fact ran a pyramid scheme or referral, which very much discounted the fees if there where referrals. Referrals would likely be a close school friend.
    I feel very sad for the tarnish it has caused .Esp the common Indian working there is bound to be looked upon as a fraud case - and he would have nothing to do with this AT ALL,it spoils the prospects and reputation of genuine people be it anyone Telegu or Non ..as long as he is Indian.
    Now all the local regional associations are desperately painting them as scapegoats because if otherwise it will be a big dent to their own rep. And next the Feds will want to go smell fish at any AP run consulting firm . A general fraud impression will be built rapidly around that community.Very unfortunate if that happens. But WHY in the 1st place attempt such a massive fraud ? Bad for all. I just hate it .
    BTW all this 1500 student game is happening when the H1B visa laws are the most restrictive so companies find it imposs to file a fresh H1B but its a lot easier to transit a student from F to H.
